Between Technologies AtomicMD inc. (NEQ 1182357328), “AtomicMD”, and the health professional who accepts these terms at sign-up, “the professional”.
Purpose.
The professional receives personal access to AtomicMD, a documentation and clinical reasoning support assistant for emergency medicine. Access is individual and reserved for physicians whose registration has been verified.
Decision support only.
AtomicMD makes no clinical decision: it does not make a diagnosis, does not prescribe and does not direct patient care. The application suggests; the professional reviews, corrects and signs. They remain fully responsible for their practice and for any content they approve or place in the record.
Health information.
The professional enters in AtomicMD only the information needed for the encounter they document, in compliance with their professional and ethical obligations. Before recording an encounter, they inform the person concerned and obtain their consent, which they confirm in the application. AtomicMD is not a medical record: the official record remains that of the institution or clinic.
Confidentiality of access.
The professional keeps their access confidential, does not share their account and reports any suspicious use without delay.
Data.
Data is hosted in Québec, in the Montréal region, and governed by Québec’s law on the protection of personal information (Law 25). The privacy policy, available at any time, states what is collected, why, for how long and by whom. The professional can export their data and delete a record or their account from the application.
Availability.
AtomicMD does what is reasonable to maintain the service, without guaranteeing uninterrupted availability. If the service is unavailable, the professional continues according to the usual procedure of their setting. Incidents affecting their data are reported to them according to the privacy policy.
Service improvement and quality of suggestions.
AtomicMD may use the professional’s comments, reactions and reports to improve the service, without obligation or compensation, in de-identified form and without attaching any health information. To check the quality and safety of the artificial intelligence’s suggestions, the solution keeps, for each call to a model, what was sent to it and what it answered, for ninety days. The professional authorizes a physician designated by AtomicMD, bound by professional secrecy, to read the traces they themselves have questioned through a reaction or a report, as well as a small random sample, solely for this verification; these readings are recorded in the log, a questioned trace is kept until its review and for no more than six months, and no information from these reviews is disclosed in a form that could identify a person.
Term and termination.
The terms apply from acceptance until the account is closed, at the professional’s request or at AtomicMD’s initiative in case of breach, with notice. The professional can export their data before closure.
Acceptance. The terms are accepted at sign-up, by checking the box provided. The date of acceptance and the version of the accepted text are kept on the account. If the text changes, the application asks for a new acceptance at the next sign-in.
